**CANCELLATION AND RETURN CONDITIONS**

**CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS**

**GENERAL:**

When you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

Shipping costs for product delivery shall be borne by the buyers.

Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

The purchased product must be delivered complete and in accordance with the specifications specified in the order and, if applicable, with warranty certificates and user manuals.

In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from the date of learning of this situation. The total amount must be refunded to the buyer within 14 days.

**IF THE PURCHASED PRODUCT PRICE IS NOT PAID:**

If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product shall cease.

**PURCHASES MADE USING UNAUTHORIZED USE OF CREDIT CARD:**

If it is determined after the delivery of the product that the credit card used by the buyer to make the payment was used by unauthorized persons unjustly, and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days with the shipping cost borne by the seller.

**IF THE PRODUCT CANNOT BE DELIVERED IN TIME DUE TO UNFORESEEN REASONS:**

If there are unforeseen circumstances beyond the control of the seller and the product cannot be delivered within the stipulated time, the buyer shall be informed of this situation. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstruction is removed. If the buyer cancels the order; if the payment was made in cash, the payment shall be refunded in cash within 14 days from the cancellation. If the buyer made the payment via credit card and cancels the order, the product price shall be refunded to the bank within 14 days from the cancellation, but it is possible that the bank may transfer the amount to the buyer's account within 2-3 weeks.

**THE BUYER'S OBLIGATION TO INSPECT THE PRODUCT:**

The buyer shall inspect the goods/services subject to the contract before taking delivery; they shall not accept damaged and defective goods/services such as crushed, broken, torn packaging from the cargo company. The goods/services received shall be deemed undamaged and intact. The buyer must protect the goods/services carefully after delivery. If the right of withdrawal is to be used, the goods/services must not be used. The invoice must be returned with the product.

**RIGHT OF WITHDRAWAL:**

The buyer may exercise the right of withdrawal from the contract by refusing the goods within 14 (fourteen) days from the date of delivery of the purchased product to the buyer or the person/organization at the address indicated, without assuming any legal or criminal liability and without providing any reason, by notifying the seller through the contact information below.

**DURATION OF THE RIGHT OF WITHDRAWAL:**

If the buyer has purchased a service, this 14-day period begins on the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the service has started with the consumer's approval before the expiration of the right of withdrawal period.

The costs arising from the exercise of the right of withdrawal shall be borne by the seller.

To exercise the right of withdrawal, written notification must be sent to the seller within 14 (fourteen) days by registered mail, fax, or email, and the product must not be used within the framework of the provisions of the "Products for which the Right of Withdrawal cannot be Exercised" section of this contract.

**USE OF THE RIGHT OF WITHDRAWAL:**

The invoice of the product delivered to the third party or the buyer (If the invoice of the product to be returned is corporate, it must be sent along with the return invoice issued by the institution when returning. Order returns whose invoices are issued on behalf of the institutions will not be completed unless the RETURN INVOICE is issued.)

The return form, the products to be returned must be delivered complete and undamaged, including their box, packaging, and standard accessories, if any.

**RETURN CONDITIONS:**

The seller is obliged to return the total price and the documents that put the buyer under debt to the buyer within 10 days from the receipt of the withdrawal notice and to return the goods within 20 days.

If there is a decrease in the value of the goods or if returning becomes impossible due to a reason caused by the buyer's fault, the buyer is liable to compensate the seller's damages at the rate of their fault. However, the buyer is not liable for changes and deteriorations caused by the proper use of the goods or products within the right of withdrawal period.

If the campaign limit amount set by the seller is reduced due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign is canceled.

**PRODUCTS THAT CANNOT BE RETURNED:**

Products that are prepared according to the buyer's request or explicitly personalized and are not suitable for return, underwear bottoms, swimwear and bikini bottoms, makeup products, single-use products, perishable or expired products, products that are not suitable for return due to health and hygiene reasons if the packaging is opened by the buyer after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, periodicals such as newspapers and magazines other than those provided under the subscription agreement, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer, and sound or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if the packaging has been opened by the buyer, cannot be returned as per the Regulation. Additionally, it is not possible to use the right of withdrawal for services that have started with the approval of the consumer before the expiration of the right of withdrawal period as per the Regulation.

Cosmetic and personal care products, underwear products, swimwear, bikini, books, copyable software and programs, DVD, VCD, CD, and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) can only be returned if their packaging is unopened, untested, undamaged, and unused.

**DEFAULT AND LEGAL CONSEQUENCES**

The buyer agrees, declares, and undertakes that if the payment transactions are made via credit card and the buyer defaults, they will pay interest within the framework of the credit card agreement with the cardholder bank and will be liable to the bank. In this case, the relevant bank may take legal action; and may request the expenses and attorney fees arising from the buyer. In any case, if the buyer defaults on their debt, the buyer agrees to compensate the seller for the damages and losses incurred due to the delayed performance of the debt.
